Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of our website, https://www.azalea.africa/, operated by Azalea Foods (“we,” “us,” or “our”).

By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.


1. General Use of the Website

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Site strictly in accordance with these Terms for the purpose of shopping for information on our products and services and making reservations.

You agree not to:

  • Use the Site for any illegal or unauthorized purpose.
  • Modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Site.
  • Use any robot, spider, scraper, or other automated means to access the Site for any purpose without our express written permission.
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site.

2. Restaurant Reservations

Through our Site, you have the ability to make a reservation at our restaurant.

  • Booking: When you make a reservation, you agree to provide accurate, current, and complete information as required by the reservation form. All reservations are subject to availability and our final confirmation.
  • Arrival Time: We will hold your reservation for 15 minutes past the booked time. After this period, your reservation may be released to other guests.
  • Cancellations: We kindly ask that you cancel your reservation as early as possible if your plans change. You can do this by replying to your confirmation email or calling us directly.
  • No-Shows: While we do not currently charge for individual no-shows, we reserve the right to do so for large party reservations that are cancelled without sufficient notice. We may also refuse future reservations from guests with a history of repeated no-shows.

3. Online Orders and Third-Party Services

Our Site contains links that will direct you to third-party online ordering and delivery platforms (“Third-Party Services”). We are not responsible for the content, policies, or practices of these Third-Party Services.

  • Your Relationship: When you use a Third-Party Service to place an order, your transaction is solely between you and that provider. Their terms of service and privacy policy will govern your order and payment.
  • Liability: We are not liable for any issues that may arise from your use of these Third-Party Services, including but not limited to payment processing, order accuracy, delivery delays, or the quality of the service provided by the third party.

4. User-Generated Content

You may have the opportunity to post content, such as inquiries through our contact form (“User Content”). By posting User Content, you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and display such content for the purpose of operating and promoting our business.

You are solely responsible for your User Content. You agree not to post any content that is unlawful, defamatory, obscene, abusive, or that infringes on the rights of any third party. We reserve the right, but are not obligated, to remove any User Content that we deem inappropriate.

IN NO EVENT SHALL AZALEA FOODS, OUR DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCTS PROCURED USING THE SITE.

Food Allergies: Our kitchen handles ingredients like nuts, gluten, dairy, and other common allergens. While we take precautions, we cannot guarantee the complete absence of cross-contamination. It is your responsibility to inform our staff of any food allergies or dietary restrictions when ordering.


8. Indemnification

You agree to indemnify, defend, and hold harmless Azalea Foods and our parent, subsidiaries, affiliates, partners, officers, directors, and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.


9. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions. Any dispute arising from these Terms will be resolved in the courts located in Abuja, Nigeria.


10. Changes to Terms and Conditions

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms constitutes acceptance of those changes.
